Welcome to Kame'e Alise Studio. By accessing or using this website and/or making a purchase, you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, do not use or purchase from this website. Generally, these Terms are governed by Canadian contract principles and applicable consumer protection rules.

1. Intellectual Property

All artwork, images, text, graphics, designs, and other content on this website remain the exclusive property of Kame'e Alise and Kame'e Alise Studio and are protected under Canadian copyright law. Ownership of a purchased artwork does not transfer copyright or reproduction rights. This means purchasers are welcome to share images of their purchases on social media, but they may not reproduce, sell, distribute, or create derivative works without written permission. Canadian copyright law provides the creator with exclusive rights to their work.

2. Orders and Acceptance

When you place an order, you are offering to purchase on and subject to the prices and terms stated here. Acceptance of an order and the formation of a contract between you and Kame'e Alise Studio occurs when we send you a confirmation email that the order has been accepted and is being processed.

3. Payment and Currency

All prices are in Canadian Dollars (CAD) unless otherwise stated. You are responsible for any taxes, duties, or fees that may apply outside of Canada. Kame'e Alise Studio is not responsible for customs fees, import taxes, or other charges outside of the purchase price collected at checkout.

4. Shipping and Delivery

Shipping timelines vary depending on product type. Originals and made-to-order works may take additional time until shipment readiness. You must provide accurate address information at checkout. Kame'e Alise Studio is not responsible for deliveries to incorrect addresses provided by the purchaser.

If a package is lost, damaged in transit, or fails to be delivered due to an incorrect address submitted by the buyer, replacement or refund is at our discretion and may be subject to additional fees.

5. Risk of Loss

Once the artwork leaves our possession and is in the hands of the carrier, the risk transfers to you. We do our best to package art safely and use reputable couriers, but mishandling after delivery is not our responsibility.

6. Refunds, Returns, and Exchanges

Your satisfaction is important. If an item arrives damaged or materially different from its description, please contact us within 7 days with photographs and details so we can assess a replacement or refund.

Because art is subjective, we do not accept returns for change of mind. Returns for reasons other than damage, defect, or misrepresentation are at our discretion and may not be eligible for full refund.

Shipping costs for approved returns or exchanges are generally not covered by Kame'e Alise Studio unless otherwise explicitly stated in writing.

7. Limitation of Liability

To the fullest extent permitted by law, Kame'e Alise Studio and its directors or representatives shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the website, purchase, or inability to purchase, including lost profits, loss of data, or damage to products after they leave our possession.

8. Third-Party Links and Services

This website may contain links to third-party sites. We are not responsible for the content, policies, or practices of third-party websites. Accessing them is at your own risk.

9. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of that province.

10. Changes to Terms

We may revise these Terms at any time. Notice of changes will be posted here. Continued use of the website after changes become effective is your acceptance of those changes.
